Making a Criminal Complaint at the State Attorney's Office
If you have been the victim of a crime you should contact the police. If you have been the victim of a misdemeanor offense, under most situations the police cannot arrest the offender unless the offense was committed in the police officer's presence. If that is the case, the police officer will give you a card directing you to pursue the matter at the State Attorney's Office.
If you have been directed by the police to pursue the matter with the State Attorney's Office, you will need to bring the information provided by the police to the State Attorney's Office. At that time you will be interviewed by an intake paralegal. In most cases the intake paralegal will take your complaint and you will later be advised of the decision of the State Attorney's Office. In some cases you will discuss the matter with a misdemeanor attorney.
If you have been the victim of a felony, and the offender has been arrested, you will be contacted by the prosecuting attorney regarding your feeling toward prosecution. If the offender has not been arrested, but is known, the police officer who took your complaint will come to the State Attorney's Office and ask about the possibility of pursuing charges. You will be contacted by the prosecuting attorney.

Misdemeanor Complaint Against a Juvenile
When a victim wishes to file a misdemeanor complaint against a juvenile, the victim should go to the Juvenile Assessment Center, located at 1241 East 8th Street. Victims must have the suspect's correct name, address, date of birth (or at least the age) before a complaint can be filed. If the Sheriff's Office provided the victim a referral card, that card should also be brought in.
