PTI - Pre-Trial Intervention Program PTI was designed primarily for adult first-time offenders who meet specific criteria. Participants sign a deferred prosecution agreement requiring that they remain law abiding, complete a minimum of 10 hours community service, pay restitution (if applicable), and participate in counseling, if required. The offender's progress is monitored while he or she is participating in the program. Upon the successful completion of the program, charges are dismissed. If an offender fails to complete required conditions of the PTI contract, the case may then be rejected from the program and returned to the prosecutor for review and appropriate legal action.
Drug Court Program This diversion program is for defendants arrested for offenses involving the purchase of drugs, possession of drugs and non-violent felonies which are clearly drug-related. To be accepted into this program, defendants must meet specific criteria and go through an intensive interview and screening process. Defendants who fail to satisfy program requirements are rejected from the program and the case is returned to the prosecutor for appropriate legal action.
REP - Restitution Enforcement Program Since the abolishment of the Municipal Court system, city and state government agencies have had an increasingly difficult time dealing with municipal code violators. The Restitution Enforcement Program (REP) began as support for city and state agencies and to alleviate the cumbersome court process. The types of municipal ordinance cases most commonly handled are health code violations and HUD housing safety violations. The program also handles economic crimes such as public assistance fraud, unemployment compensation fraud, revenue fraud (failure to pay state sales tax), and certain types of theft and forgery cases. Defendants sign a deferred prosecution agreement, agreeing to pay restitution. Community service work hours may be an additional part of the agreement. Prosecution is deferred until all conditions of the deferred prosecution agreement are met. The maximum period of deferment is 36 months. A program participant must fulfill all conditions of the deferred prosecution agreement. Failure to do so results in the case being referred back to the prosecutor for review and possible prosecution.
