Adults or Juveniles - Court Cases

The instructions and checklist below applies to Adults and Juveniles who went to court, as well as Adults who successfully participated in diversion programs.

Begin the process by obtaining an Application Of Eligibility from the Clerk of the Court located in the Duval County Courthouse. Please read carefully. We cannot give legal advice. The State Attorney's Office only signs the Application for Expunction if charges were dropped.

For a Sealing, the State Attorney's Office does not need to sign the Application of Eligibility. It is your responsibility to fill out the application or obtain the advice of an attorney. Please read the checklist below to start the process. It will take approximately two to three months to complete the process.

The packets you receive from the Clerk of Court's Office will have all the documents and instructions you need to complete your Sealing or Expunction.

    Juveniles - Diversion Cases

    A juvenile who has sucessfully completed a diversion program is eligible to have his/her case sealed, if an application is made within six months of successful completion of said program.  Along with the Juvenile Diversion Expunction application form, which can be obtained from the Juvenile Clerk's Office, a letter from the State Attorney's Office indicating completion of the diversion program must be included.

    The packets you receive from the Clerk of Court's Office will have all the documents and instructions you need to complete your Sealing or Expunction.
