Overview

The Jacksonville Environmental Protection Board has been given authority to promulgate and adopt local environmental rules pursuant to Chapter 360.108, Municipal Ordinance Code. The rules are adopted from state and federal regulations or based upon studies and best management practices. All rules are presented at a public hearing with participation of affected parties or industries.

This rule relates to organization procedure and practice of the Environmental Protection Board.

Variances

The Jacksonville Environmental Protection Board (JEPB) is granted the authority to grant variances for just cause from any of the requirements or standards in the rules adopted pursuant to Chapter 362 (Air and Water Pollution) and Chapter 368 (Noise Control).  Variance requests may be made only in hardship or special cases on the basis of sound technical, economic and environmental data. 
 
The variance process is outlined in Chapter 360.111.  There are required notice and public hearings associated with each variance application which impact the processing time of applications.  Contact staff for more detailed information and explanation.  Variance applications and background information are provided below.
